1. Acceptance of These Terms
These Terms of Use (“Terms”) are an agreement between you and One Earth Solar LLC (“1 Earth Solar,” “we,” “us,” or “our”). They govern your use of our website at 1earthsolar.com, our online forms and portals, and our email, telephone, and text messaging channels.
By using our website or communicating with us through these channels, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use our website or submit information to us.
2. What These Terms Cover and What They Do Not
These Terms apply to your use of our website and communication channels only.
They do not govern the sale, design, installation, financing, warranty, or service of a solar energy system. That work is governed by the separate written agreements you sign with us, which may include a home improvement contract, a solar installation agreement, a limited warranty, and any financing or third-party ownership agreement you enter into with a financing provider. Where these Terms conflict with a signed agreement covering your project, that signed agreement controls. Nothing in these Terms waives, limits, or replaces any right, warranty, or disclosure you are entitled to under those agreements or under applicable law.
3. Mobile Messaging Terms
These messaging terms apply to the 1 Earth Solar Customer Care messaging program.
Program description. 1 Earth Solar uses text messaging to communicate with customers, prospective customers, and business partners. Messages relate to inquiries you have submitted, quotes and proposals, account and project status, appointment scheduling, site visits, installation and inspection coordination, service requests, and general customer support. This is a conversational support program. We do not send unsolicited outbound marketing text messages through this program.
How you opt in. You consent to receive text messages from us by initiating a text message to one of our published numbers, by providing your mobile number and affirmatively agreeing to receive text messages on one of our forms or in a written agreement with us, or by texting a designated keyword to one of our numbers. Where more than one method applies, each is a separate and independent opt-in.
How to opt out. You can cancel text messages from us at any time. Reply STOP to any message you receive from us. After you reply STOP, we will send one message confirming that you have been unsubscribed, and you will not receive further text messages from that number. If you want to start receiving messages again, opt in the same way you did the first time, or contact us and ask us to resume messaging.
How to get help. Reply HELP to any message for assistance. You can also reach our support team directly at contact@1earthsolar.com or (844) 803-2784.
Message frequency. Message frequency varies and depends on your inquiry and the activity on your account or project. Because this is a conversational program, you will generally receive messages only in response to a message you send or in connection with a scheduled event on your project.
Cost. Message and data rates may apply to any message sent to you by us and to any message you send to us. These charges are set by your wireless carrier, not by us. If you have questions about your text or data plan, contact your wireless provider.
Carrier liability. Wireless carriers are not liable for delayed or undelivered messages.
Supported carriers. Message delivery is subject to the capabilities and terms of your wireless carrier. Not all carriers or handsets support all message types.
Not a condition of purchase. Consent to receive text messages is not a condition of purchasing any product or service from us.
Privacy. We do not sell, rent, or share mobile phone numbers, text messaging opt-in information, or SMS consent with any third party or affiliate for marketing or promotional purposes. If you have questions about how we handle your information, read our Privacy Policy.
Changes to your number. If you change or give up your mobile number, notify us promptly so that we do not send messages intended for you to someone else.
4. Eligibility
You must be at least 18 years old to use our website, submit information to us, or participate in our messaging program. By using our website, you represent that you meet this requirement.
5. Website Content and Intellectual Property
Unless otherwise noted, all content on our website, including text, graphics, logos, photographs, designs, and software, is owned by One Earth Solar LLC or used under license, and is protected by copyright, trademark, and other laws. All rights are reserved.
You may view, download, and print website content for your own personal, non-commercial use in evaluating our products and services. Any other use requires our prior written permission.
6. Acceptable Use
You agree not to:
- Republish, sell, sublicense, or otherwise commercialize website content without our written permission.
- Use our website or messaging channels for any unlawful, fraudulent, harassing, or abusive purpose.
- Submit false, misleading, or impersonating information, or submit another person’s information without that person’s permission.
- Attempt to gain unauthorized access to our website, servers, portals, or any account.
- Introduce malware, or use automated tools to scrape, overload, or interfere with our website or its availability to other users.
- Use our brand, logos, or content in a way that suggests affiliation or endorsement that does not exist.
We may suspend or terminate access to our website, portals, or messaging channels for any violation of these Terms.
7. Submissions and Referrals
If you submit content to us, including photographs of your property, questions, reviews, or testimonials, you grant us a non-exclusive, royalty-free license to use that content in connection with providing our services and, where you have given permission, in our marketing materials. You represent that you have the right to submit the content.
If you submit another person’s contact information through our referral program, you confirm that you have that person’s permission to do so. Referral rewards are subject to the specific terms of the referral program in effect at the time of the referral.
8. Proposals, Estimates, and Savings Projections
Information on our website and in any preliminary proposal, quote, or savings estimate is provided for general informational purposes and is not a binding offer.
Solar energy production estimates, utility bill savings figures, payback periods, and incentive or tax credit values are projections based on modeling assumptions, historical utility data, current program rules, and information available at the time they are prepared. Actual results depend on factors outside our control, including weather, shading changes, roof condition, utility rate changes, your electricity consumption, equipment performance, interconnection timelines, and the availability, funding levels, and rules of federal, state, and utility incentive programs, which are subject to change or termination.
We do not guarantee any specific level of energy production, bill savings, or incentive value, and nothing on our website constitutes tax, legal, or financial advice. Consult a qualified tax advisor about your eligibility for any tax credit or deduction. Binding terms, pricing, and any production guarantee, if offered, appear only in your signed agreements.
9. Authorized Representatives
Only individuals authorized by 1 Earth Solar may represent our company, quote pricing, or collect information on our behalf. If someone contacts you claiming to represent 1 Earth Solar, you can confirm their status through our Verify a Rep page or by calling (844) 803-2784.
We are not responsible for statements, promises, or agreements made by any person who is not an authorized representative, or by an authorized representative acting outside the scope of their authority. No representation is binding on us unless it appears in a written agreement signed by an authorized officer of 1 Earth Solar.
10. Third-Party Websites and Services
Our website may link to or integrate with third-party websites and services, including those of financing providers, utilities, permitting authorities, and incentive program administrators. We do not control those services and are not responsible for their content, availability, terms, or privacy practices. Your use of a third-party service is governed by that party’s terms.
11. Disclaimer of Warranties
Our website and its content are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that the website will be uninterrupted, secure, or error-free, or that content is complete or current.
This disclaimer applies to our website and messaging channels only. It does not disclaim, limit, or affect any warranty we provide on a solar energy system, on installation workmanship, or on equipment under your signed agreements or under applicable law.
12. Limitation of Liability
To the fullest extent permitted by law, One Earth Solar LLC and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or business interruption, arising out of or relating to your use of our website or messaging channels, regardless of the legal theory and even if we have been advised of the possibility of such damages.
Our total aggregate liability arising out of or relating to your use of our website and messaging channels will not exceed one hundred dollars ($100.00).
These limitations do not apply to: liability for our gross negligence, willful misconduct, or fraud; personal injury or property damage caused by our work; any liability arising under your signed home improvement, installation, warranty, or service agreements; or any liability that cannot be limited or excluded under applicable law. Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless One Earth Solar LLC and its officers, directors, employees, and agents from any claims, losses, liabilities, damages, costs, and reasonable attorneys’ fees arising out of your breach of these Terms, your misuse of our website or messaging channels, or your submission of another person’s information without authorization. This provision does not apply to claims arising from our own negligence or misconduct.
14. Copyright Complaints
If you believe content on our website infringes your copyright, send a written notice to contact@1earthsolar.com including: identification of the copyrighted work, identification of the material you believe infringes it and where it appears on our site, your contact information, a statement that you have a good faith belief the use is not authorized, and a statement under penalty of perjury that the information in your notice is accurate and that you are the owner or authorized to act on the owner’s behalf. We will investigate and respond as required by the Digital Millennium Copyright Act.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of Illinois, without regard to its conflict of laws rules. Any dispute arising out of or relating to these Terms or your use of our website will be brought exclusively in the state or federal courts located in Illinois, and you consent to the personal jurisdiction of those courts.
Before filing any claim, you agree to contact us and attempt in good faith to resolve the dispute informally. This section does not apply to any dispute governed by a dispute resolution provision in a signed agreement between us, which controls for matters within its scope.
16. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last Revised” date at the top of this page. Changes take effect when posted. Your continued use of our website after a change constitutes acceptance of the updated Terms. We encourage you to review this page periodically.
17. General
Severability. If any provision of these Terms is held invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force.
No waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
Assignment. We may assign or transfer these Terms in connection with a merger, acquisition, or sale of assets. You may not assign these Terms without our written consent.
Entire agreement. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding your use of our website and messaging channels, and supersede any prior understandings on that subject. They do not supersede your signed project agreements.
Headings. Section headings are for convenience only and do not affect interpretation.
